中国民主党主张政治转型过渡期内,实行三级司法体制,并实行地方司法独立,中央司法不独立的司法半独立制度。三级司法包括:中央巡回法庭、地区高等法庭和地区法庭。司法系统的各级法庭、所有法官、所有司法辅助人员、司法执行力量和安全保卫力量都只对最高法院的大法官委员会负责;大法官委员会只对执政党中央最高领导层负责,不对任何地方政党和政府领导人负责。所有法官的选拔、晋升、待遇和保障,都由最高法院的大法官委员会指派的机构负责。所有法庭的管理、控制、监督、保护和执行,都由最高法院的大法官委员会指派的机构负责。
China Democracy Party advocates a three-tier justice system during political transition period. The local judiciary system should be independent while the Central judiciary system may not be independent right away, which makes it a semi-independent judiciary system. The three-tier justice system include Central Circuit Court, Local Supreme Court and District Court. All levels of court, Judges, legal assistants, execution power and safety guard only carries responsibility from the Central Supreme Court Grand Jury Committee. The Grand Juries only carries responsibilities from head leader of Central Government, not any local political or governmental leaders. The nomination and promotion of Judges, and the Judges' benefits are administrated by the organization specially assigned by the Central Supreme Court Grand Jury Committee. The courts' management and administration issue, protection and execution of court order are carried out by agencies appointed by Central Supreme Court Grand Jury Committee.
目前,中国有数百万党政官员有能力干预和干扰各级司法,制造了巨大数量的司法腐败、司法不公和社会不公的案件,也造成了数千万人到各级政府上访的现状。实行司法半独立制度后,由于执政党中央最高领导层的官员与普通百姓相隔很多级,他们之间的直接利益冲突和厉害冲突很少,他们因私利干预司法的机率非常少;而任何地方政党和政府领导人无权干预司法,他们面对司法半独立制度,将很难有机会因私利干预司法。
Currently, China's millions of Party and Government officials have the ability to intervene and interfere with the judiciary at any levels, creating a tremendous amount of corruption in the judiciary system, and many cases of judicial injustice. Nowadays, tens of millions of people petition at all levels of government seeking justice. Since the highest level of Central Government officials have little direct conflict of interests with ordinary people, they have least opportunity to directly intervene the justice system. While any local Party or Governmental leaders have no right to interfere with justice. With semi-independent judicial system, it will be difficult for them to intervene in the judiciary for personal purpose.
对于大案、要案、重案、争议较大的案件、被控诉司法不公的案件、被控诉适用法律不当的案件和对社会影响较大的案件等,采用法官陪审团制度。最高法院要根据需要,筛选足够数量的机动法官。来自不同地域、互不相识,并在审案期间被隔离的机动法官组成法官陪审团,对案件进行裁决,以保证裁决结果公正;对于牵涉百姓利益最多的民事纠纷案件和行政处罚案件,实行地区小额法庭制度。所有不接受任何类型行政处罚决定的人,通过小额法庭进行裁决。
Some cases should adopt Judge-Jury trial, for example, major and important cases, cases with great discrepancy, complaints of misconduct of justice system, complaints of improper application of the law, or socially influential cases. The Supreme Court may select sufficient number of mobile Judges according to the needs. In order to make the trial just, the Jury should be made of Judges from different regions, don't know each other, and in segregated from outside during the trial. Small claims court should be established for local civil dispute and administrative issues. Those who want to dispute any type of administrative decision should go through the Small Claims Court.
如果在法官那里可以找到公平和正义,大批上访百姓就不再需要找清官,而是找法官。实行司法半独立制度作为政治转型期内的过渡制度,虽然不能解决全部问题,但可以解决和缓解绝大部分各级官员干预司法、司法腐败和司法不公的现状,并为未来实现司法完全独立打下坚实的和稳定的基础。
If fairness and justice can be achieved in the Court, then a large number of petitioners no longer have to seek justice from government officials, but they will turn to the Judge instead. Although a Semi-independent is not supposed to solve all the problems during political transition period, it can solve the vast majority of problems of officials' intervention in judicial system, judicial corruption and judicial injustice, and establish a solid and stable foundation for the completely independent judicial system in the future.
