司法独立是指司法机关独立于政党、行政机构和立法机关；法官行使职权时，只服从法律，不受任何政党、行政机构和立法机关的干涉。

The justice's independence is that the justice organization must be independent form the political parties, the administration organizations and legislative body; when the justice is using their power, they only follow the law, and they donót accept the interfering of the political parties, the administration organizations and legislative body.

中国民主党主张实行三权分立制度，而司法独立将成为三权分立中以权力制约权力的重要支柱。司法部门只有不听命于政党、行政机构和立法机关，才能主持正义，保护公民的生命、财产与自由。司法只有独立，才能对政党、行政机构和立法机关加以约束，防止它们滥用权力和走向腐败。

China Democracy Party advocate to carry out the system that the three power are separated, and the justiceós independence will become the important pillar that the power was restricted by the power in the system of the three separated power. The justice department only doesnót obey the order of the political parties, the administration organizations and legislative body, they can uphold justice, guard the life, properties and freedom. The justice is only independent; it will bind the political parties, the administration organizations and legislative body, guard against to abuse their power, and guard against them to be rotten.
